These Terms of Use govern your access to and use of the ThinkProfiler assessment, its credit system, and any reports generated through the service. By using ThinkProfiler, either as an inviting Professional (Coach) or as an individual Participant (Client), you agree to these Terms.
To ensure clarity throughout this document, the following definitions apply:
"Service": The ThinkProfiler website, assessment platform, and underlying software infrastructure.
"Assessment": The cognitive and self-reflection questionnaire provided via the Service.
"Report": The generated PDF document containing cognitive architecture analysis and insights.
"Coach / Professional": The business user or entity purchasing Credits and inviting Clients to take the Assessment.
"Client / Participant": The individual invited to take the Assessment.
"Credit": A pre-paid token allowing a Coach to invite one (1) Client and generate one (1) Report.
"Account": The personal dashboard and access credentials created by a Coach.
ThinkProfiler is a self‑reflection and cognitive assessment tool designed to help users understand their information‑processing preferences and cognitive architecture. It is intended for personal insight, coaching, and individual development.
Important Disclaimer: ThinkProfiler is not a medical, psychological, or psychiatric diagnostic instrument. It does not identify, evaluate, or treat disorders, conditions, or impairments.
Age Limit: You must be at least 16 years old to use ThinkProfiler. If you are between 13 and 16 years old, you may only use the service with the explicit, verifiable consent of a parent or legal guardian.
Account Responsibility (For Coaches): You are solely responsible for maintaining the confidentiality of your Account credentials (username and password). Any activity occurring under your Account is your responsibility. You agree to notify us immediately at report@thinkprofiler.com of any unauthorized use or suspected security breach.
The information provided by ThinkProfiler:
Is not clinical, psychological, or medical guidance.
Should not be used as a standalone selection instrument or as the decisive factor for employment, promotion, or termination decisions.
Should not be used to make decisions with binding legal, financial, medical, or psychological consequences.
Professional Responsibility: ThinkProfiler is strictly a technical service provider. We are not responsible or liable for any misuse, unauthorized sharing, or improper/harmful interpretation of Reports by Coaches or third parties.
If you access ThinkProfiler as a Coach:
Credit Usage: One (1) Credit allows you to invite one (1) Client to complete the Assessment and generates one (1) Report.
Credit Validity & Rolling Expiration: Purchased Credits are valid for 24 months from the date of your last Credit purchase. Any subsequent purchase of new Credits will extend the validity of your entire remaining Credit balance for another 24 months. Unused Credits will permanently expire after this period without eligibility for a refund.
The 2-Month Assessment Window: If a Client does not start or complete the Assessment within 2 months (60 days) after the invitation is sent, the pending record is automatically deleted for data hygiene, and the Credit is fully returned to the Coach’s balance.
Pricing & Payments: Prices for Credits are displayed on the website and are processed securely via our third-party payment providers. Where applicable, VAT (BTW) or other sales taxes will be calculated and added at checkout in accordance with local tax regulations. If ThinkProfiler is exempt from charging VAT at the time of purchase, the price shown is the final price. We reserve the right to adjust our pricing at any time; however, price changes will not affect already purchased Credits.
Refund Policy: Outside of the service discontinuation policy (Section 8), Credits are non-refundable and cannot be exchanged for cash.
All content—including assessment questions, scoring formulas, report texts, algorithms, and visual designs—is the exclusive intellectual property of ThinkProfiler.
Acceptable Use: You agree not to:
Attempt to reverse engineer, decompile, copy, or redistribute the Assessment logic, questions, or software.
Use the Service for any illegal or unauthorized purposes.
Use automated systems, bots, scrapers, or bulk-download tools to access or harvest data from the Service.
Use our proprietary questions, report texts, or scoring logic to train, build, or commercialize competing profiling tools or AI models.
Sharing the Report: Clients and Coaches may share the personal generated PDF Report with third parties, provided the document remains unaltered and includes all original branding, copyrights, and disclaimers.
AI & LLM Integration: You are permitted to upload personal Report text to third-party AI tools (such as ChatGPT or Claude) strictly for personal analysis, summarization, and self-reflection.
Your use of ThinkProfiler is also governed by our Privacy Policy.
When you invite a Client to take the Assessment, you act as the Data Controller under the GDPR. ThinkProfiler acts strictly as your Data Processor.
You warrant and guarantee that you have obtained the necessary explicit consent or have another valid legal basis under the GDPR to invite your Client and to receive their generated Report.
You agree to handle and store your Client's Report with strict confidentiality and in compliance with applicable privacy laws.
Automatic Delivery: If you take this Assessment via an invitation link from a Coach, you acknowledge and agree that your generated Report will be automatically sent directly to your inviting Coach.
Data Retention: All client personal data and generated Reports are stored for a maximum of 12 months. After 12 months, your personal data and reports will be permanently deleted or fully anonymized.
Availability: ThinkProfiler is provided on an "as is" and "as available" basis. While we strive for maximum uptime, we cannot guarantee uninterrupted access due to reliance on third-party infrastructure (such as hosting, databases, and form providers).
Force Majeure: We are not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to network outages, cyber-attacks, natural disasters, government actions, or failures of third-party service providers.
Discontinuation & Refund Protection: In the highly unlikely event that ThinkProfiler permanently discontinues its service, we will provide active credit holders with a minimum of 90 days' prior notice. During this notice period, you will have the opportunity to use your remaining Credits. Any remaining valid, unused Credits that cannot be used before the discontinuation date will be refunded pro-rata based on your original purchase price.
We reserve the right to temporarily suspend or permanently terminate your Account and revoke access to the Service (including active Credits) without a refund if:
You materially violate any provision of these Terms of Use or our Acceptable Use Policy.
You violate applicable data protection laws (including the GDPR) regarding your Clients' data.
We detect fraudulent, abusive, or harmful activity associated with your Account.
To the fullest extent permitted by law:
ThinkProfiler is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Service or reliance on the generated Reports.
Liability Cap: In any event, our total liability for any claims arising out of or related to the use of the Service shall not exceed the total amount paid by you to ThinkProfiler for Credits in the twelve (12) months preceding the event giving rise to the liability. This limitation applies regardless of the legal theory under which the claim is brought, including contract, tort, negligence, or otherwise.
Nothing in these Terms excludes liability where such exclusion is not permitted by applicable law.
We reserve the right to modify these Terms of Use at any time.
Notification: If we make significant changes that materially affect your rights or the credit system, we will provide notice via email to the address associated with your account at least 30 days before the changes take effect.
Acceptance: Your continued use of ThinkProfiler after the updated Terms have been published constitutes your acceptance of the new terms.
These Terms of Use are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or the use of ThinkProfiler will be submitted exclusively to the competent court in the Netherlands.
